In accordance with EU Regulation 1177/2010, C&T Minor Islands is responsible for the damage resulting from the loss or damage of mobility equipment or other specific equipment used by persons with disabilities or reduced mobility, if the harmful event is attributable to the fault or negligence of the carrier or terminal operator.
The fault or negligence of the carrier is presumed when the damages have been caused by a maritime accident.
The compensation corresponds to the replacement value of the equipment in question or, if applicable, to the repair cost.
Compensation does not apply to the Article 4 of the Regulation (EC) No. 392/2009, of the European Parliament and of the Council of April 23, 2009 concerning the liability of carriers transporting passengers by sea in case of accidents (1) OJ L 131, 28.5.2009, p.24.
Any requests for compensation should be sent to servizioclienti@carontetourist.it.
In order to ensure the success of the request, passengers are always encouraged to report any damage to their mobility equipment to the On-Board Command, even if the carrier’s liability is only suspected.
